Extraordinary Retroactive Legalization of Buildings in Mallorca

A unique opportunity to regularize your property

The recently approved Decree on the Simplification and Rationalization of Administration in the Balearic Islandsopens up an exceptional opportunity:
the retroactive legalization of constructions built outside urban planning regulations that have so far existed in a legal grey area.

In other words:
A house or finca built without a permit, an unlawfully constructed swimming pool, or a garage (carport) can now be legalized retroactively — provided certain conditions are met.

This opportunity is time-limited:
The deadline is three years from June 20, 2024. After this period, no further retroactive legalization will be possible.

What does this extraordinary legalization mean?

It allows expired or “time-barred” constructions to obtain official legal recognition. This brings significant advantages:

  • Substantial legal security for property owners
  • Regularization of the property with the authorities
  • Possibility of inheritance, sale, and registration in the Land Registry

What general conditions apply?

Each case must be assessed individually. In general:

  • The construction must be time-barred (verjährt).
  • It cannot be used for tourist rental.
  • The costs of legalization increase each year, the later the application is submitted.
