The urban planning statute of limitations is crucial for the legalization of properties in Mallorca. After certain deadlines, authorities can no longer sanction or demolish illegal buildings. Prescribed buildings are still considered originally constructed without permits, but under specific conditions, they can be legalized.
Deadlines depend on the type of land:
Urban land: 8 years from completion of construction
Rural land: 15 years or more, depending on protection status and surroundings
The period starts once construction is fully completed. Any subsequent work can interrupt the period and reset the deadline.
Not all buildings qualify for prescription. It does not apply to:
Buildings in protected environmental or coastal areas
Constructions on land with special scenic or ecological value
New constructions or extensions after the original period
Projects that violate environmental or safety regulations
